1. Service
BlueCallerAI provides software and automation tools designed to help plumbing businesses handle inbound calls, collect customer details, support scheduling workflows, and manage follow-up actions. Features may include AI call handling, phone-number provisioning, CRM syncing, dispatcher alerts, analytics, and related onboarding tools.
2. Eligibility and Accounts
You must be authorized to act on behalf of your business and provide accurate account information. You are responsible for activity under your account, keeping credentials secure, and controlling who in your team has access to the service.
3. Billing and Usage Charges
Paid features may require an active subscription. You agree to pay subscription charges, applicable usage charges, telecom charges, taxes, and third-party fees associated with your account. Charges may include Stripe subscription fees and telephony costs such as Twilio phone numbers, calling, messaging, forwarding, or related carrier usage.
If payment fails or your subscription becomes past due, we may limit or suspend paid functionality, including self-serve phone provisioning or other live-service features.
4. Customer Communications and Consent
You are responsible for making sure your business has all notices, permissions, and legal bases required for call handling, call recording, voicemail, SMS, AI-assisted communications, and any customer outreach performed through the service. You are also responsible for complying with applicable telecom, privacy, consumer protection, and recording-consent laws in every place where you operate.
5. SMS / Text Messaging Program Terms
BlueCallerAI operates two distinct SMS programs. The first sends operational alerts to plumbing business owners and their staff who have signed up for the service. The second sends transactional booking confirmations to end customers who have requested service from a plumber that uses BlueCallerAI. The terms below apply to both, with program-specific details called out where they differ.
5a. BlueCallerAI Account Alerts (plumbing business owners and staff)
Program name: BlueCallerAI Alerts.
Program description: By opting in to the BlueCallerAI Alerts program, you agree to receive recurring SMS text messages from BlueCallerAI related to your account, such as new-lead notifications, missed-call alerts, dispatcher updates, two-factor authentication codes, billing and account notices, and customer support replies.
Message frequency: Message frequency varies based on your account activity and the alerts you enable. You should expect to receive messages whenever a relevant account event occurs (for example, when a new call is missed or a new booking is created on your account).
Opt-in: You enroll in the program by providing your mobile phone number during account signup or in your account settings and confirming that you agree to receive SMS messages from BlueCallerAI. Consent to receive marketing or promotional text messages is not a condition of purchasing any goods or services.
5b. Booking Confirmations on Behalf of Plumbers (end customers)
Program name: Booking Confirmations.
Program description: When you call a plumbing business that uses BlueCallerAI to handle their phones, our AI receptionist may offer to text you a confirmation of your appointment. If you agree on the call, you will receive transactional SMS messages from the plumber's BlueCallerAI-managed number related to your specific service request, for example, a booking confirmation, a reminder, a dispatcher update, a cancellation, or a reschedule notice. These messages are sent on behalf of the plumbing business that you called; the plumbing business is the sender of record and BlueCallerAI is the technology platform used to deliver the messages.
Message frequency: Transactional only. You will only receive messages related to your specific appointment(s), typically one confirmation, optional reminders before the appointment, and optional follow-up messages if the appointment changes. You will not receive marketing or promotional messages through this program.
Opt-in: Your consent is captured verbally during your phone call with the AI receptionist. The AI will tell you the number it intends to text and ask whether that is okay. We log your affirmation, the phone number, and a timestamp as the record of consent. If you decline on the call, we will not text you. You may also opt out at any time after the fact using the instructions below.
Terms that apply to both programs
Message and data rates: Message and data rates may apply. Neither BlueCallerAI nor the plumbing business charges for the messages themselves, but standard message and data rates from your mobile carrier may apply to each message sent or received. Please contact your wireless provider for details about your plan.
Carriers: Carriers are not liable for delayed or undelivered messages. Service is available on most major U.S. and Canadian carriers but is not guaranteed to work on all carriers or devices at all times.
Opt-out instructions: You can cancel either SMS program at any time. Simply reply STOP to any message you have received from the relevant number. After you send STOP, we will send you one confirmation message and you will not receive further messages from that number. STOP opt-outs are honored on a per-number basis, so opting out of one plumbing business's confirmations does not affect any other number. If you want to opt back in, just sign up again or ask the AI receptionist to text you the next time you call.
Help: If you are experiencing issues with either messaging program you can reply with the keyword HELP to any message for more assistance, or you can get help directly at info@bluecallerai.net or by calling 1 (855) 604-5694.
Privacy: Mobile phone numbers and SMS opt-in data are never shared with third parties or affiliates for marketing purposes. End-customer phone numbers collected through the Booking Confirmations program are used solely to deliver the specific transactional messages described above. For full details on how your information is handled, please review our Privacy Policy.
6. Acceptable Use
You may not use the service to break the law, misrepresent your business, send spam, transmit malicious code, attempt unauthorized access, or process data you are not permitted to use. You may not use the service in a way that interferes with its security, stability, or availability for other customers.
7. Third-Party Services
Parts of the service may depend on third-party providers such as Stripe, Twilio, Clerk, Jobber, cloud infrastructure providers, or AI/model vendors. Their systems are outside our direct control, and outages, feature changes, delays, or policy changes from those providers may affect the service.
8. No Guarantee of Results
We aim to improve responsiveness and booking workflows, but we do not guarantee uninterrupted service, perfect transcription accuracy, booking accuracy, lead conversion, or any specific business outcome. You should review critical automations and keep a human escalation path available for situations where that is appropriate.
9. Suspension and Termination
We may suspend or terminate access if your account is used unlawfully, creates security risk, becomes seriously past due, or violates these terms. You may stop using the service at any time, subject to any billing terms already incurred.
10. Disclaimers and Liability
The service is provided on an "as is" and "as available" basis to the maximum extent allowed by law. To the fullest extent permitted by law, BlueCallerAI disclaims implied warranties and is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of the service.
11. Changes
We may update these terms as the product evolves. Continued use of the service after an update means you accept the revised terms.
